Terms of Service

1. Definitions

"Service" refers to the Eriga platform, accessible at app.eriga.app, including all features, APIs and documentation. "User" refers to any natural or legal person who uses the Service. "Account" refers to the profile created by the User to access the Service. "Space" refers to the isolated environment associated with an organization within the Service.

2. Acceptance of terms

Use of the Service implies full acceptance of these Terms. If you do not accept these Terms, you may not use the Service.

3. Registration and account

To use the Service, you must create an Account providing truthful and complete information. The User is responsible for the confidentiality of their access credentials and all activities that occur through their Account.

4. Use of the service

The Service is provided "as is". The User agrees to:

• Not use the Service for unlawful or unauthorized purposes
• Not attempt to access data or Spaces of other users
• Not interfere with the operation of the Service
• Comply with applicable laws when using the Service

5. Plans and payments

The Service offers a free plan and paid plans. Prices and features of each plan are indicated on the Pricing page of the site. Payments are managed through Stripe. Users can change plans or cancel their subscription at any time from their Account.

6. User data

The User retains full ownership of data entered in the Service. Eriga does not access User data except to provide the Service or upon explicit request from the User. The processing of personal data is governed by our Privacy Policy.

7. Service availability

Eriga is committed to ensuring maximum availability of the Service. However, we cannot guarantee uninterrupted operation. Scheduled maintenance will be communicated in advance.

8. Limitation of liability

Eriga is not liable for indirect, incidental or consequential damages arising from the use or inability to use the Service. Eriga's maximum liability is limited to the amount paid by the User in the preceding 12 months.

9. Termination

The User may close their Account at any time. Eriga reserves the right to suspend or terminate access in case of violation of these Terms, upon prior notice.

Upon Account closure, data will be deleted within 30 days, except as required by law.

10. Changes to terms

Eriga reserves the right to modify these Terms. Changes will be communicated via email or through a notice in the Service with at least 30 days' advance notice. Continued use of the Service after the modification constitutes acceptance of the new Terms.

11. Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute, the court of the User's place of residence or domicile shall have jurisdiction, if the User is a consumer.
